Terms of Service

1. Overview
Welcome to Shredpool! These Terms of Service ("Terms") govern your access to and use of the Shredpool platform, including our mobile application, website, and services (collectively, the "Service").
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
2. Cost-Sharing Platform
Important Legal Distinction:
Shredpool is a recreational cost-sharing platform, NOT a commercial transportation network company (TNC) like Uber or Lyft. This distinction is critical for legal compliance.
Key Principles:
- No Driver Profit: Drivers may only recover actual trip expenses (gas, tolls, vehicle depreciation). Drivers may NOT profit from rides.
- Recreational Purpose: All rides must be for recreational outdoor activities, primarily ski and snowboard trips to mountain destinations.
- Zero Platform Commission: Shredpool takes no commission or fee on ride cost-sharing payments. Revenue comes exclusively from user subscriptions.
- Transparent Pricing: All ride costs are calculated from real-time gas prices, tolls, and vehicle expenses. Full cost breakdown is shown before payment.
- Stripe Processing Fees: Payment processing fees (2.9% + $0.30 per transaction) are paid directly to Stripe (our payment processor), not to Shredpool. These fees are disclosed to passengers as a separate line item.
3. User Responsibilities
All Users Must:
- Be at least 18 years old
- Provide accurate and truthful information
- Comply with all applicable laws and regulations
- Treat other users with respect and courtesy
- Not use the Service for commercial transportation purposes
Drivers Must:
- Possess a valid driver's license
- Maintain adequate auto insurance that covers cost-sharing activities
- Ensure their vehicle is safe and roadworthy
- Only charge for actual trip expenses (no profit)
- Accurately represent trip details (departure time, route, vehicle capacity)
Passengers Must:
- Be ready at agreed pickup times
- Pay the agreed cost-share amount
- Respect the driver's vehicle and other passengers
- Bring only the agreed amount of equipment/luggage
4. Account Registration
To use the Service, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must notify us immediately of any unauthorized use or security breach.
5. Subscription Plans
Shredpool offers subscription plans to access ride features:
- Free Tier: 1 ride per week, basic features
- Monthly Plans: Unlimited rides, priority features
- Seasonal Plans: Best value for frequent users
Subscriptions are billed through the App Store or Google Play. Cancellations must be made at least 24 hours before renewal to avoid charges for the next period.
No Refunds: Subscription fees are non-refundable except as required by law or at Shredpool's sole discretion.
6. Payment Terms
Authorization Holds: When a driver accepts your ride request, we authorize a hold on your payment method for the cost-share amount plus processing fee. This hold lasts up to 7 days.
Payment Capture: Payment is captured only after the driver marks the trip as complete. If the trip is canceled, the hold is released.
Trip Creation Limits: Trips can only be created up to 7 days in advance to align with Stripe payment authorization limits.
Refunds: Full refunds are issued for driver cancellations. Disputed no-shows are reviewed by our support team within 48 hours.
7. Prohibited Conduct
You may NOT:
- Use the Service for commercial rideshare purposes (operating like Uber/Lyft)
- Charge passengers more than actual trip expenses
- Create fake accounts or manipulate ratings
- Harass, threaten, or discriminate against other users
- Post false or misleading information
- Violate any local, state, or federal laws
- Scrape, data mine, or collect user information
- Interfere with the Service's operation or security
8. Insurance and Liability
No Insurance Provided: Shredpool does NOT provide insurance coverage for users. Drivers are responsible for maintaining adequate auto insurance that covers cost-sharing activities.
Independent Contractor Relationship: Shredpool does not employ drivers. Users arrange rides directly with each other. Shredpool is a technology platform only.
Release of Liability: You release Shredpool from all claims arising from accidents, injuries, property damage, or disputes with other users. The driver's personal auto insurance is the primary coverage.
9. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. SHREDPOOL DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. SHREDPOOL DOES NOT GUARANTEE THE SAFETY, QUALITY, OR RELIABILITY OF RIDES ARRANGED THROUGH THE SERVICE.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SHREDPOOL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING PERSONAL INJURY, PROPERTY DAMAGE, LOST PROFITS, OR DATA LOSS ARISING FROM USE OF THE SERVICE.
11. Indemnification
You agree to indemnify and hold harmless Shredpool from any claims, losses, damages, and expenses (including legal fees) arising from your use of the Service, violation of these Terms, or violation of any rights of another user.
12. Termination
Shredpool may suspend or terminate your account at any time for violation of these Terms or for any other reason at our sole discretion. You may delete your account at any time through the app settings.
13. Changes to Terms
We may update these Terms at any time. Material changes will be communicated via email or in-app notification. Continued use after changes constitutes acceptance of the updated Terms.
14. Governing Law
These Terms are governed by California law. Disputes shall be resolved in San Francisco County, California courts.
