End User License Agreement (EULA)

1. Acceptance of Terms

By downloading, installing, or using the Shredpool mobile application ("App"), you agree to be bound by this End User License Agreement. If you do not agree to these terms, do not use the App.

2. License Grant

Shredpool grants you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with this EULA.

You may NOT:

• Copy, modify, or distribute the App
• Reverse engineer, decompile, or disassemble the App
• Remove any copyright or proprietary notices
• Use the App for commercial rideshare services
• Rent, lease, lend, sell, or sublicense the App

3. Cost-Sharing Platform

Important: Shredpool is a recreational cost-sharing platform, NOT a commercial transportation network company (TNC). By using the App:

• Drivers may only recover actual trip expenses (gas, tolls, vehicle depreciation)
• Drivers may NOT profit from rides
• All rides must be for recreational outdoor activities (ski/snowboard trips)
• Users must comply with local laws regarding cost-sharing arrangements
• Shredpool takes zero commission on ride payments (subscription revenue only)

4. User Accounts

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying Shredpool immediately of any unauthorized use
• Providing accurate, current, and complete information

You must be at least 18 years old to create an account and use the App.

5. Prohibited Conduct

You agree NOT to:

• Use the App for illegal purposes or in violation of any laws
• Harass, threaten, or harm other users
• Post false, misleading, or fraudulent information
• Interfere with the App's operation or security
• Scrape, data mine, or collect user information without consent
• Use the App for commercial rideshare services (e.g., operate like Uber/Lyft)
• Create fake accounts or manipulate ratings/reviews

6. Payments and Subscriptions

Subscriptions:

• Subscriptions are billed through the Apple App Store or Google Play Store
• Payment will be charged to your iTunes/Google Play account at confirmation of purchase
• Subscriptions auto-renew unless canceled at least 24 hours before the end of the current period
• Manage subscriptions and turn off auto-renewal in your Account Settings

Ride Payments:

• Ride cost-sharing payments are processed through Stripe
• Payment is authorized when a driver accepts your request
• Payment is captured only after trip completion
• Stripe processing fees (2.9% + $0.30) are disclosed upfront and paid by passengers
• Refunds are issued for driver cancellations or disputed no-shows

7. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. SHREDPOOL DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING:

• Merchantability, fitness for a particular purpose, and non-infringement
• Accuracy, reliability, or completeness of content
• Uninterrupted or error-free operation
• Safety or quality of services arranged through the App

Shredpool does NOT provide transportation services. Users arrange rides directly with each other. Shredpool is not responsible for the conduct of drivers or passengers.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SHREDPOOL SHALL NOT BE LIABLE FOR:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or use
• Personal injury, property damage, or death arising from use of the App
• Actions or omissions of drivers or passengers
• Accidents, disputes, or crimes involving users

If you have a dispute with another user, you release Shredpool from all claims, demands, and damages of any kind arising from such dispute.

9. Indemnification

You agree to indemnify and hold harmless Shredpool, its officers, directors, employees, and agents from any claims, losses, damages, liabilities, and expenses (including legal fees) arising from:

• Your use of the App
• Your violation of this EULA
• Your violation of any rights of another user
• Your violation of any laws or regulations

10. Insurance Requirements

Drivers: You are responsible for maintaining adequate auto insurance that covers cost-sharing activities. Shredpool does NOT provide insurance coverage. Check with your insurance provider before using the App as a driver.

Passengers: You acknowledge that the driver's personal auto insurance is the primary coverage. Shredpool does not provide supplemental insurance.

11. Termination

Shredpool may suspend or terminate your account at any time for any reason, including violation of this EULA. Upon termination, your license to use the App immediately ends. You may delete your account at any time through the App settings.

12. Governing Law

This EULA is governed by the laws of the State of California, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in San Francisco County, California.

13. Changes to this EULA

Shredpool may update this EULA at any time. We will notify you of material changes through the App or via email. Continued use of the App after changes constitutes acceptance of the updated EULA.
